PAT Scholarship Test

  1. PAT is a free scholarship test (“Test”) organized by Digital PACE Education Pvt. Ltd in association with its parent entity, subsidiaries and/or affiliates (“Digital PACE”). Participation to the Test is subject to acceptance of these terms and conditions.
  1. The Test shall be governed by the following terms and conditions (“PAT Terms”) read with the terms and conditions governing usage of the Platform, including the privacy policy and any other policy of the Platform (collectively, “Terms of Use”). You hereby acknowledge and agree that the Terms of Use are incorporated herein by reference. Terms not defined herein shall have their meaning ascribed in the Terms of Use.
  1. Upon your participation in the Test, you may be eligible to win such prize or benefits as determined by Digital PACE at its sole discretion and displayed on the Platform or communicated by Digital PACE in writing over email or any other mode of communication (each, a “Prize ”) The method and criteria of awarding and distribution of the Prize shall be determined by Digital PACE at its sole discretion and governed by the Prize Terms set forth below.
  1. All students studying in grades 7th– 10th and 12th passouts except the enrolled students of Digital PACE are eligible to participate in the Test, and will be eligible for any scholarship program offered by Digital PACE (or any of the benefits thereunder) as part of the Prize.
  1. You hereby represent and warrant that (a) you are competent to enter into a valid binding contract in accordance with the applicable laws;or (b) you have the requisite rights and consent to enter into these PAT Terms and Prize Terms. If you are agreeing and consenting to these terms on behalf of any other person, you have the requisite legal authority and consent of the person on whose behalf you are agreeing and consenting to these terms. However, if you are a minor, i.e. under the age of 18 years, you may participate in the Test and use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these PAT Terms read with the Prize Terms and Terms of Use.
  1. In addition to the above mentioned eligibility requirements to participate in the Contest, you are required to have a valid residential address, contact number and e-mail id and must be registered as a valid user on the Platform. For the avoidance of doubt, please note that the Test is open to participation by individuals only. Corporate entities, agencies and any non-human legal entities are not allowed to participate in the Test. Employees, consultants, interns, and educators associated with Digital PACE are not eligible to participate in the Test.

    If Digital PACE determines at any time that you are not in compliance with any of the PAT Terms or Terms of Use, your participation in the Test shall be treated as null and void ab initio, and you shall not be eligible for the Prize or any component thereof.

 

  1. Additionally, the following criteria shall be applicable to participate in the Test:

(i) For Class XII and Passout NEET/ IIT-JEE Aspirants: Students studying in Class 12th or passout as on 1st Jan of the relevant year.

(ii) For Class XI NEET/IIT-JEE Aspirants: Students studying in Class 10th as on 1st Jan of the relevant year.

(iii) For Class VI- X NEET/ IIT-JEE Foundation Aspirants: Students studying in Class 6-10 respectively as on 1st Jan of the relevant year.

  1. Ranking Criteria: Participants securing the highest marks by completing the Test in the least time duration shall be used as the criteria to determine the ranks. In the event where two or more participants to the Test secure the same marks, the time taken to complete the Test shall be used as a tiebreaker to determine the ranks of such participants, and the participant who has taken lesser time complete the Test shall be ranked higher.
  1. The results of the Test along with the final ranks secured by the participants to the Test shall be declared within 10 days after completion of the Test. Digital PACE shall not be liable in any manner for any delay in declaring the results of the Test as a result of any factors or reasons beyond the reasonable control of Digital PACE.
  1. Information that is available on the official web page of the Platform shall be regarded as the only authentic and valid information with respect to the Test. Digital PACE shall not be responsible for any incorrect or misleading information relating to the Test, presented, or displayed on any other source other than the official web page of the Platform, and shall not be liable for any loss or damage suffered by you in this regard.
  1. To participate in the Test, you are required to follow the following steps:
  • Log in to your Digital PACE account on the Platform.
  • Participate in the Test while it is live and active on the Platform.
  • You must appear for the Test live to remain eligible for the Prize(s).
  1. Responses to the Test questions should be submitted by you while the Test is live and available on the official web page on the Platform. You can begin the Test once it is live, but the Test will end at the stipulated end time automatically.
  1. The Test shall be conducted on such dates as displayed on the Platform or communicated by Digital PACE in writing over email or any other mode of communication from time to time. Digital PACE reserves the right to modify the dates at any time by displaying the revised dates on the Platform without any prior notice to you.
  1. After the results of the Test are announced, Digital PACE will conduct a thorough evaluation to determine if the Participants have participated in the Test in accordance with the PAT Terms and the Terms of Use.
  1. If Digital PACE determines at any time that you have violated any of the PAT Terms or Terms of Use, or engaged in any unlawful or unethical practices, including but not limited to, having prior access to the questions in the Test, usage of any circumventing technology to manipulate the Platform algorithm or any act which gives you an unfair advantage over other participants of the Test: (a) your participation in the Test shall be treated as null and void ab initio; (b) you shall not be eligible for the Prize or any component thereof; and (c) Digital PACE may at its sole discretion cancel any Prize or benefits without any liability to you, and take such other actions as set forth in the Terms of Use and pursue such remedies as available to Digital PACE under applicable laws.
  1. If Digital PACE determines that you have participated in the Test using multiple accounts or any other method in violation of the PAT Terms or Terms of Use, you shall be forthwith disqualified automatically without the requirement of any notice and shall not be entitled to the Prize or any benefit or component thereof. Additionally, you shall be barred from participating in any future Test, contests, exams itself at the sole discretion of Digital PACE.
  1. Digital PACE shall have sole and absolute discretion in determining the participants who have secured the top ranks in the Test (each, a “Top Ranker ”) in accordance with its policies and procedures read with the applicable laws, rules, regulations etc., PAT Terms and Terms of Use. Digital PACE may, at its sole discretion and without any liability, disqualify the participation of any Top Ranker if it determines that the Top Ranker has violated any of the PAT Terms or Terms of Use in any manner. Upon such disqualification, the Top Ranker shall not be entitled to any Prize or any components or benefit thereof, and participation of such participant in the Test shall be deemed null and void ab initio. Any communication, clarification, query, dispute in this regard by the participant, or any of the legal heirs or guardians of such participant in any manner shall not be entertained by Digital PACE.
  1. You are solely liable to ensure that your participation in the Test is lawful and in accordance with the laws of India. Neither Digital PACE nor its representatives or agents shall be deemed to make any representations, express or implied, as to the lawfulness of the answers to the Test submitted by you or your participation in the Test. Digital PACE reserves the right to request proof of your eligibility or any other information in the event that there is any doubt over your eligibility or participation in the Test.
  1. Upon your participation in the Test, you hereby acknowledge and agree that you shall participate in the Test for yourself and not for any third party in any manner.
  1. You hereby consent to and grant Digital PACE a perpetual, irrevocable, exclusive, worldwide, royalty free, fully paid-up, unlimited, assignable, transferable and sublicensable right and license to use in any form, manner and medium whatsoever, at the sole and absolute discretion of Digital PACE, the Content, your name, photo, image, visual representation, comment, or statement, in any media for promotional, marketing, and advertising purposes or any other objective by Digital PACE, as deemed appropriate by Digital PACE at its sole discretion.

The “ use ” referred to herein means use, copy, display, distribute, modify, translate, reformat, incorporate into advertisements and other works, analyse, promote, commercialize, create derivative works, and in the case of third-party services, allow their users and others to do the same.

” Content ” means and includes (but is not limited to) images, photos, audio, video, and all other forms of information or data in any form of media that you submit, upload, share or transmit to Digital PACE, through or in connection with the Test, such as images, photos, messages, videos, and any other materials.

  1. It may happen that the Platform is inaccessible or non-functional, either for planned maintenance or any other reason. You accept that you will not have any recourse against Digital PACE in any of these types of cases where the Platform may not be available to you for a period of time. Digital PACE, its parent entity, subsidiaries, affiliates, and each of their directors, officers, licensors, suppliers, partners, agents and representatives make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Test content, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Digital PACE and its parent entity, subsidiaries, affiliates, and each of their directors, officers, licensors, suppliers, partners, agents and representatives make no warranty that you will obtain specific results by participating in the Test. Your participation in the Test is entirely at your own risk.

Digital PACE may decide to cease making available certain features of the Platform at any time and for any reason without any prior notice. Under no circumstances shall Digital PACE or its parent entity, subsidiaries, affiliates, and each of their directors, officers, licensors, suppliers, partners, agents and representatives be held liable for any damages due to such interruptions or lack of availability of such features.

Digital PACE shall not be responsible for any loss or damage caused if Digital Pace is required to postpone, discontinue, delay, alter, modify or cancel the Test pursuant to compliance with any law of there is failure of performance of the Platform caused by events beyond the reasonable control of Digital PACE, including without limitation, an act of war, hostility, or sabotage, epidemic, pandemic, natural disaster, electrical, internet, or telecommunication outage, or government restrictions, new legislation regulation or requirement or instruction of any Central or State government, rulings, order, judgement or for any other unavoidable reason beyond its reasonable control.,

  1. Digital PACE will not be responsible in case anyone is unable to participate in the Test on account of not having access to the Test for any reason.
  1. To the fullest extent permitted by applicable laws, you hereby indemnify and keep Digital PACE, its parent entity, subsidiaries, affiliates and each of their directors, officers, employees, agents, consultants, and representatives harmless and indemnified against any loss, damage, claims, costs and expenses which may be brought against Digital PACE, incurred or suffered by Digital PACE due to (a) your participation in the Test; (b) use of Content provided by you to Digital PACE; or (c) breach of any of the PAT Terms.
  1. Digital PACE shall not be liable to you or any third party for any indirect, special, remote, punitive, exemplary, incidental, or consequential cost, expense, loss or damage whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise, even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by you or Digital PACE. Digital PACE accepts no responsibility for difficulties experienced in submitting answers to the Test. Digital PACE does not accept responsibility for (a) lost, late or answers not submitted for any reason, or (b) any technical or access issue, failure, malfunction, or difficulty that might hinder your ability to participate in the Test, or (c) any event which may cause the Test to be disrupted in any manner.
  1. Subject to the foregoing, in no event shall the maximum aggregate liability of Digital PACE for any losses, damages, or claims arising out of or in connection with the Test exceed the amount paid by you to Digital PACE to undertake the Test, in any circumstances.
  1. Digital PACE reserves the right to modify, add, substitute, or delete the PAT Terms at any time at its sole discretion without any prior notice to you.
  1. Any disputes with respect to the Test shall be governed by and construed in accordance with the laws of India, without reference to principles of conflict of laws. The courts in Mumbai shall have exclusive jurisdiction to determine any disputes arising out of, under, or in relation to, the Test.
  1. The rights and remedies available to Digital PACE as set out in these terms and conditions are without prejudice and in addition to any other right or remedy that Digital PACE may have under applicable laws.

Prize Terms.

  1. The contest (” Contest “) to win the Prize (as defined in the relevant terms) is conducted by Digital PACE Education Private Limited in association with its parent entity, subsidiaries and/or affiliates (“ Digital PACE ”).
  1. Participation in the Contest is purely voluntary in nature and does not guarantee winning of the Prize. Mere participation should not be perceived as any commitment on the part of Digital PACE to select a participant as the winner. Nothing herein amounts to a commitment by Digital PACE to conduct further, similar or other contests in future.
  1. The winner(s) of the Contest shall be eligible to claim the Prize after taking admission to the JEE and/or NEET courses as per the criteria mentioned by Digital PACE. Additionally, the winner(s) of the Contest shall interact with the faculty members of Digital PACE at the time of claiming the prize, in such form and manner as determined by Digital PACE at its sole discretion.
  1. Digital PACE shall have the sole discretion to determine the number of Prizes and winners of the Contest. A Participant who has received a Prize for the Test shall not be eligible for any other prize in any other exam or test irrespective of his/her Test ranking. The winner(s) of the Contest shall be given the Prize(s) subject to these terms and conditions.
  1. Any ranks or marks with respect to the Test that are granted before the official announcement of the Test results by Digital PACE shall be considered provisional and cannot be used to claim any Prize.
  1. Digital PACE shall contact the winner(s) of the Contest within a commercially reasonable period of time after determining the winners of the Contest. In the event there is no response from the winner(s) of the Contest within seven (7) days from the date of receipt of the communication sent by Digital PACE, the Prize shall be deemed to be forfeited without the requirement of any notice, or any liability to Digital PACE.
  1. The winner(s) of the Contest needs to submit such details as required by Digital PACE, including name, postal address with pin code and govt. issued address proof, govt. issued birth certificate with govt. issued age proof, contact number, photograph with govt. issued ID proof, valid proof of admission to the relevant course offered by Digital PACE, current and previous years’ mark sheets, any other document or information requested by Digital PACE, and a no-objection certificate to the satisfaction of Digital PACE within seven (7) days from the date of receipt of the communication sent by Digital PACE in order to claim the Prize. Digital PACE shall dispatch the Prize within ninety (90) days of successful verification of the details provided by the winner of the Contest. Digital PACE shall not be liable for any loss that occurs during the dispatch of the Prize to the address provided by the winner(s) of the Contest.
  1. Digital PACE shall have the absolute and sole discretion to determine whether any winner of the Contest should be disqualified by reason of failure to abide by these terms and conditions, bad faith, fraud or any other reason at the sole discretion of Digital PACE.
  1. Incomplete information provided by a participant, failure to provide true and accurate information as required by Digital PACE, or failure to submit proof of identification or any other information required by Digital PACE will automatically disqualify the winner(s) of the Contest, and the Prize shall stand forfeited without the requirement of any notice, or any liability to Digital PACE.
  1. Distribution of the Prize to the winner by Digital PACE shall discharge Digital PACE of any and all obligations towards the winner(s) of the Contest, and such winner(s) or any other Participant shall not be entitled to bring any claims against Digital PACE in this regard.
  1. The Contest is valid for a limited period only, subject to the sole discretion of Digital PACE. Digital PACE reserves the right at any time and from time to time to modify, suspend or discontinue, temporarily or permanently, the Contest and/or these terms and conditions without any prior notice.

The decision of Digital PACE is final and binding and no correspondence shall be entered into in this regard.

  1. The participant represents and warrants that he/she shall be solely liable to comply with the applicable laws and regulations with respect to his/her participation in the Contest.
  1. The winner(s) of the Contest shall be solely liable to comply with the applicable laws and regulations with respect to the Prize, including without limitation, obligations to pay applicable taxes and duties on the Prize.
  1. Digital PACE disclaims all responsibility associated with the Prize, including without limitation, any warranties associated with the Prize and/or any additional costs or expenses associated with the Prize, its distribution, transportation and not specifically included in the Prize. Digital PACE shall not be liable for any losses, damages, claims, taxes, liabilities or inconvenience suffered by any participant as a result of these terms and conditions, entering into this Contest or accepting any part of the Prize.
  1. Digital PACE shall not be responsible for any deficiency in the Prize and does not make any representation about the quality, make, performance, features, endurance, finishing, benefits, or fitness of the Prize. Digital PACE and its parent entity, subsidiaries, affiliates, and each of their directors, officers, licensors, suppliers, partners, agents and representatives make no representations or warranties about the suitability, reliability, availability, timeliness, security of the Prize, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  1. The Prize is offered on a ‘no exchange-no refund’ basis. Digital PACE shall not entertain any requests for exchange or substitution in lieu of the Prize offered by Digital PACE. The Prize is non-exchangeable, non-transferable, and is not redeemable for other items or prizes.
  1. Notwithstanding the above, Digital PACE, at its sole discretion, retains the right to substitute the Prize with another reward of similar value in the event the Prize is not available for any reason.
  1. Digital PACE shall not be liable to the participants or any third party for any indirect, special, remote, punitive, exemplary, incidental or consequential cost, expense, loss or damage whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise, even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and/or Digital PACE. Digital PACE accepts no responsibility for difficulties experienced in submitting answers to the Test. Digital PACE does not accept responsibility for (1) lost, late or answers not submitted for any reason, or (2) any technical or access issue, failure, malfunction or difficulty that might hinder the ability of a participant to participate in the Contest or (3) any event which may cause the Contest to be disrupted in any manner.
  1. The participant undertakes to indemnify and keep Digital PACE, its parent entity, subsidiaries, affiliates and each of their directors, officers, employees, agents, consultants, and representatives harmless and indemnified against any loss, damage, claims, costs and expenses which may be brought against Digital PACE, incurred or suffered by Digital PACE due to participant’s breach of any of the terms and conditions herein contained.
  1. The winner(s) of the Contest acknowledges and agrees that he/she is not a consumer under the applicable laws and shall not be entitled to bring any claim or action against Digital PACE with respect to the Prize.
  1. Digital PACE reserves the right to modify, add, substitute, or delete these terms and conditions at any time and at its sole discretion without any prior notice to you.
  1. Any disputes with respect to the Contest shall be governed by and construed in accordance with the laws of India, without reference to principles of conflict of laws. The courts in Mumbai shall have exclusive jurisdiction to determine any disputes arising out of, under, or in relation to, the Contest.
  1. The rights and remedies available to Digital PACE as set out in these terms and conditions are without prejudice and in addition to any other right or remedy that Digital PACE may have under applicable laws.
  1. Participation to the Contest shall be subject to acceptance of these terms and conditions.
